Public Sidewalk Easement for 3025 E. Imperial Highway

RECOMMENDATION

Accept public sidewalk easement dedication and authorize City Clerk to execute and record the easement.

BACKGROUND/DISCUSSION

On October 21, 2019, the industrial development project located at 3025 E. Imperial Hwy was approved by administrative staff under Plan Review No. PR 19-13. As part of the project approval, the property owner, 3025 E. Imperial LLC, was required to remove existing driveway approach and construct two new driveway approaches on Saturn Street in accordance with latest Americans with Disabilities Act (ADA) and City of Brea Public Works Standard requirements.

The sidewalk within the public right-of-way on Saturn Street had insufficient width to construct driveway approaches to meet ADA requirements and provide pedestrian access. Therefore, portions of the driveway approaches were constructed on private property, which require public sidewalk easement over those areas. The public sidewalk easement dedications consist of approximately 6-ft by 83-ft and 6-ft by 78-ft areas for the two new driveway approaches. The location of these improvements are shown on Exhibit 'A' - Project and Easement Location Exhibit attached herewith. The driveway approaches have been constructed per approved plans, Deed of Easement document has been reviewed by the Engineering Division and the easement form has been approved to form by the City Attorney's office. Refer to Deed of Easement for Public Sidewalk attached herewith.

FISCAL IMPACT/SUMMARY

There is no General Fund impact from the acceptance of these public sidewalk easements. The Deed of Easement for public sidewalk has been reviewed by the Engineering Division for the legal description of the easement areas and the easement form has been approved to form by the City Attorney's office. Therefore, staff is recommending the City Council to consider accepting the Deed of Easement for the dedication of public sidewalk easements.
