Deed of Easement for Brea Imperial Center Located at Southwest Corner of Imperial Highway and State College Boulevard
RECOMMENDATION
Accept public water easement dedication and authorize City Clerk to execute and record the Deed of Easement.
BACKGROUND/DISCUSSION
On July 24, 2018, the Planning Commission approved Resolution No. PC 18-07 to conditionally approve Tentative Parcel Map No. 2017-125 for Brea Imperial Center located at the southwest corner of Imperial Highway and State College Boulevard. Tentative Parcel Map No. 2017-125 proposed to subdivide an existing 4.6-acre shopping center with 2 parcels into 3 parcels.
 
On April 6, 2021, the City Council accepted Final Parcel Map No. 2017-125. As part of this final map, the property owner, JTECC Investment, LLC, dedicated a 20-foot water easement to the City of Brea. As part of the project approval, the property owner was required to install a new public fire hydrant and service line to meet building code and Fire Department requirements. Therefore, a new public water easement is required for access to said fire hydrant and service line. See Exhibit A, Location Exhibit, attached herein for reference. The fire hydrant and service line has been constructed per the approved plans. The Deed of Easement has been prepared for the proposed water line easement, which has been reviewed by the Engineering Division. Refer to Exhibit B, attached herein, for the Deed of Easement.
FISCAL IMPACT/SUMMARY
There is no General Fund impact from the acceptance of this public water easement. The Deed of Easement for public water easement has been reviewed by the Engineering Division for form and the legal description of the easement area. Therefore, staff is recommending the City Council to consider accepting the Deed of Easement for the dedication of public water easement and to authorize the City Clerk to execute and record the Deed of Easement.
