Public Water Easement for 201 North Berry Street

RECOMMENDATION

Accept public water easement and authorize City Clerk to execute and record the Deed of Easement.

BACKGROUND/DISCUSSION

On April 28, 2021, the Planning Commission approved Resolution No. PC 2020-08 for the proposed private development at 201 N. Berry Street. This resolution included Conditions of Approval for the property owner, IDI Brea LLC, to complete in order to facilitate the proposed development. The Conditions of Approval included an item requiring the property owner to prepare and submit public improvement plans for all improvements proposed within the public right-of-way of N. Berry Street.

One such improvement proposed for the project was to modify the existing driveway approaches to facilitate truck turning movements necessary for the proposed future business operations. The modification of the southern driveway approach caused the need to relocate an existing public air release valve to be outside the footprint of the proposed driveway, within private property. See Exhibit A, attached herein, for the property location and the location of the proposed public water easement. The Deed of Easement has been prepared for the proposed water line easement and reviewed by the Engineering Division. Refer to Exhibit B, attached herein, for the Deed of Easement.

FISCAL IMPACT/SUMMARY

There is no General Fund impact from the acceptance of this public water easement. The Deed of Easement for the public water easement has been reviewed by the Engineering Division for form and the legal description of the easement area. Staff recommends City Council to accept the Deed of Easement for the dedication of public water easement and to authorize the City Clerk to execute and record the Deed of Easement.
