Amendment No. 1 to Professional Services Agreement with Karen Warner Associates to include the General Plan Safety Element Update 
RECOMMENDATION
Amend the scope of work and contract amount, extend the contract until completion, and authorize the City Manager to execute the amendment and all required documents with Karen Warner Associates (KWA) for the Housing Element Update to include updating the General Plan Safety Element in the amount of $22,906 plus a 15% contingency, in addition to the existing executed contract of $85,000, for a total contract amount of $111,342. KWA is currently assisting staff in the Housing Element Update for the 6th Cycle (Years: 2021-2029).
BACKGROUND/DISCUSSION
The Safety Element is an element of the General Plan as required by the State of California. The goal of the Safety Element is to reduce the potential short and long-term risk of death, injuries, property damage, economic and social dislocation resulting from fires, floods, droughts, earthquakes, landslides, climate change, and other hazards. In 2019, Senate Bill 99 (SB-99) was passed requiring emergency route identification in the Safety Element if the jurisdiction did not have an adopted Local Hazard Mitigation Plan (LHMP). If no LHMP has been adopted, SB-99 requires jurisdictions to update the Safety Element in conjunction with the Housing Element Update.

As such, the amendment would add to KWA’s scope of work to include updating the Safety Element in conjunction with the Housing Element. KWA’s sub-consultant, Rincon Consultants, Inc. (Rincon), is currently completing the California Environmental Quality Act (CEQA) analysis for the Housing Element. Rincon would assist KWA on updating the Safety Element consistent with SB-99. Rincon's scope includes a review of the existing Safety Element and the City's Emergency Preparedness Program to provide recommendations for policy changes and additions to be compliant with the most recent regulations. Rincon would also expand their CEQA analysis to evaluate all updates to the General Plan associated with this effort. A copy of their proposal is attached to this report.

Due to timing, this item was not available to the Finance Committee.

 
FISCAL IMPACT/SUMMARY
There is no General Fund impact.

The proposed amendment is in the amount of $22,906 plus a 15% contingency for a total of $26,342. This would change the total contract amount with KWA from $85,000 to $111,342. The original $85,000 contract with KWA was appropriated by Council in FY 2019/2020 and budgeted $51,000 from the General Plan Maintenance Fund (120) and $34,000 from the Successor Agency Housing Fund (280). In early 2020, the City received $160,000 in Senate Bill (SB-2) Planning Grants Program funds of which $35,000 was earmarked for the Housing Element Update. Thus, there is no impact to the General Fund. Staff is simply recommending to re-allocate $35,000 for the Housing Element to the Safety Element Update.
