Procedures for Addressing the Council
The Council encourages interested people to address this legislative body by making a brief presentation on a public hearing item when the Mayor calls the item or address other items under Matters from the Audience. State Law prohibits the City Council from responding to or acting upon matters not listed on this agenda. The Council encourages free expression of all points of view.  If appropriate, a spokesperson may present the views of your entire group. Council rules prohibit clapping, booing or shouts of approval or disagreement from the audience. PLEASE SILENCE ALL DEVICES. 

To provide comments via Zoom or to provide written comments (which will be summarized aloud into the
record at the meeting), members of the public must contact City Staff at (714) 990-7756 or email
cityclerksgroup@cityofbrea.net no later than 12:00 p.m. on Tuesday, May 3, 2022. Upon request, Zoom participants will be provided with a Zoom meeting ID and password and will remain muted during the meeting until recognized at the appropriate time by the Council. The meeting will also be broadcast live at www.cityofbrea.net.

13.   General Plan Amendment No. 2021-04 and Zone Change No. 2021-02 to change the General Plan land use and Zoning designations of the Brea Plaza shopping center, located at 1639 East Imperial Highway, from General Commercial to Mixed Use II - Second Reading of Ordinance No. 1226, an Ordinance of the City Council of the City of Brea approving Zone Change No. ZC 2021-02 to change the zoning of the Brea Plaza Shopping Center located at 1639 E. Imperial Highway from General Commercial to Mixed Use I. 
 
14.   Introduce Ordinance Adding Chapter 2.32 to the Brea Municipal Code Relating to Electronic and Paperless Filing of Fair Political Practices Commission Campaign Disclosure Statement - Introduce Ordinance No. 1228, Adding Chapter 2.32 to the Brea Municipal Code Relating to Electronic and Paperless Filing of Fair Political Practices Commission Campaign Disclosure Statement, by title only, and waive further reading. Funding for the system is included in the IT data processing budget for next fiscal year. 
 
15.   Proposed Water and Sewer Fees - Provide Feedback on Proposed Water and Sewer Fees; and Instruct staff to move forward with a Public Hearing. The proposed water rates do not provide additional revenue to the water utility fund but shifts current revenue to cover fixed charges which allows the water fund to be less reliant on water consumption for continued operation.
 
CONSENT CALENDAR - The City Council/Successor Agency approves all Consent Calendar matters with one motion unless Council/Agency or Staff requests further discussion of a particular item. Items of concern regarding Consent Calendar matters should be presented during “Matters from the Audience."

16.   April 19, 2022 City Council Regular Meeting Minutes - Approve. 
 
17.   AB 361 Findings for Special Brown Act Requirements for Teleconference Meetings - Make the following findings: (1) the City Council has reconsidered the circumstances of the COVID-19 state of emergency; and (2) the COVID-19 state of emergency continues to directly impact the ability of the members of the City’s legislative bodies (including commissions and committees) to meet safely in person. There is no fiscal impact to the General Fund.
 
18.   Adopt Resolution and Award Contract to Three Peaks Corp. for the Brea Downtown Parklets Project, CIP No. 7328 (“Project”)  - Approve the Plans and Specifications; Receive bids; Adopt Resolution 2022-034 to allocate $830,000 from the Community Benefit and Economic Development Fund (140); Award Contract to the lowest responsive and responsible bidder, Three Peaks Corp., in the Amount of $274,500 for Bid Alternatives (Shade Sails) Parklets A and C and Bid Additive Item LED Lighting for Parklets A and C only and any additional parklets will come back to City Council for approval; and Authorize the City Engineer to issue Change Orders up to a "not to exceed" amount of 15% of the Contract Price. There will be no fiscal impact to the General Fund.
 
19.   Arovista Park Modernization, CIP 7978 - Adopt Resolution 2022-035 to Appropriate $680,000 from the Park Development Fund, (Fund 250) for Project Design and Golf Course Safety Netting. Staff recommends appropriating $680,000 from the Park Development Fund 250 for the design and safety netting. There is sufficient fund balance in the Park Development Fund for this project.
 
20.   Rejection of Bids for the Berry Street Sidewalk Project, CIP No. 7324 - Reject all bids and direct the City Clerk to return all bid bonds. There is no fiscal impact to the General Fund.
 
21.   Rejection of Bids for the Fire Station No.1 Seismic Retrofit Project, CIP No. 7923 - Reject all bids and direct the City Clerk to return all bid bonds and authorize staff to re-advertise for bids. There is no fiscal impact to the General Fund
 
22.   Approval of Memorandum of Understanding Between the City of Brea and the Brea Fire Management Association - Adopt Resolution No. 2022-036 approving Memorandum of Understanding (MOU) with the Brea Fire Management  Association (BFMA). The net financial impact of entering this contract is $242,946 to the General Fund assuming the new staffing model for a Brea only fire department. The adopted budget for FY 2021-22 and projected budgets for FY 2022-23 and FY 2023-24 already includes $242,946 for the General Fund. The budget needed for the remainder of the current fiscal year is only $664 and will be programmed in the 2nd quarter budget adjustments.
