RECOMMENDATION

Approve First Amendment to Supercharger Agreement

BACKGROUND/DISCUSSION

On October 6, 2020, City Council approved the Supercharger Agreement with Tesla to install a total of 48 electric vehicle (EV) charging stations in Parking Structure No. 2 located at 175 S. Madrona Avenue. The proposal included installation of 24 wall chargers (also know as Level II or Universal chargers for any EV user) and installation of 24 superchargers that are only to be used by Tesla vehicles.

An amendment to the agreement is needed because “Exhibit A” of the original agreement incorrectly stated that Tesla would service and maintain the Southern California Edison (SCE) equipment. Since SCE would be responsible to maintain their own equipment, this amendment properly assigns the responsibilities and ownership of the electrical equipment that is being installed for this project to SCE.

The City Attorney has reviewed the attached First Amendment to Supercharger Agreement and approves as to form. Tesla anticipates starting construction in August / September 2021 and complete by early December 2021 or sooner.

FISCAL IMPACT/SUMMARY

There is no fiscal impact associated with this action.
