Such documents may also be available on the City’s website subject to staff’s ability to post documents before the meeting.

Procedures for Addressing the Council

The Council encourages interested people to address this legislative body by making a brief presentation on a public hearing item when the Mayor calls the item or address other items under Matters from the Audience. 

State Law prohibits the City Council from responding to or acting upon matters not listed on this agenda. The Council encourages free expression of all points of view. If appropriate, a spokesperson may present the views of your entire group. Council rules prohibit clapping, booing or shouts of approval or disagreement from the audience. PLEASE SILENCE ALL DEVICES. There will be no Zoom/Teleconference for the Study Session meeting.  Zoom/Teleconference will be available during General Session only, members of the public must contact City Staff at (714) 990-7756 or email cityclerksgroup@cityofbrea.net no later than 12:00 p.m. on the day of the meeting.  All written comments received by 12:00 p.m. on the day of the meeting,
will be summarized aloud into the record at the meeting. Upon request, Zoom participants will be provided with a Zoom meeting ID and password and will remain muted during the meeting until recognized at the appropriate time by the Council. The meeting will also be broadcast live at www.cityofbrea.net.

PUBLIC HEARING - This portion of the meeting is for matters that legally require an opportunity for public input.  Audience participation is encouraged and is limited to 5 minutes per speaker.
 
10.   Public Hearing to Consider Levying an Assessment for Landscape and Lighting Maintenance Districts (LLMDs) #1, 2, 3, 4, 5, 6 and 7 for Fiscal Year 2022-2023 - Adopt Resolution Nos. 2022-037 through 2022-043, levying assessments for Fiscal Year 2022-2023 after receiving testimony at the Public Hearing on June 7, 2022. There is no fiscal impact to the General Fund.

11.   Adopt Level 2 Water Shortage Condition Resolution - Adopt Resolution No. 2022-044, declaring the existence of a Level 2 Water Shortage Condition.
 
CONSENT CALENDAR - The City Council/Successor Agency approves all Consent Calendar matters with one motion unless Council/Agency or Staff requests further discussion of a particular item. Items of concern regarding Consent Calendar matters should be presented during “Matters from the Audience."

12.   May 17, 2022 City Council Regular Meeting Minutes - Approve. 
 
13.   May 20, 2022 City Council Special Meeting Minutes - Approve. 
 
14.   AB 361 Findings for Special Brown Act Requirements for Teleconference Meetings - Make the following findings: (1) the City Council has reconsidered the circumstances of the COVID-19 state of emergency; and (2) the COVID-19 state of emergency continues to directly impact the ability of the members of the City’s legislative bodies (including commissions and committees) to meet safely in person. There is no fiscal impact to the General Fund.
 
15.   November 8, 2022 General Municipal Election Authorization and Consolidation Request - Adopt Resolution No. 2022-045 calling and giving notice of the holding of a General Municipal Election on Tuesday, November 8, 2022 for the election of certain officers as required by the provisions of the laws of the State of California relating to General Law cities; and Adopt Resolution No. 2022-046 requesting the Board of Supervisors of the County of Orange to consolidate a General Municipal Election held on November 8, 2022 with the Statewide General Election to be held on that date pursuant to Section 10403 of the California Elections Code. Funding for the 2022 General Municipal Election has been allocated into the Fiscal Year 2022-23 proposed budget. There is no fiscal impact to the General Fund. 
 
16.   Budget Adjustments to the City Operating Budget for Fiscal Year 2021-22 - Adopt Resolution No. 2022-047, appropriating funds to adjust the Fiscal Year 2021-22 City Operating Budget. The City Operating Budget adjustments for the General Fund (110) resulted in an increase in revenues of $424,740 and an increase in expenditures of $52,979, for a net General Fund increase in revenues over expenditures of $371,761. The City Operating Budget adjustments for all funds including the General Fund resulted in an increase in revenues of $484,740 and an increase in expenditures and transfers-out of $65,044, for a net increase in revenues of $419,696.
 
17.   Fiscal Year 2022-23 Building Utilities and Services Agreement with Brea Olinda Unified School District - Approve One-Year Building Utilities and Services Agreement with the Brea Olinda Unified School District for Fiscal Year 2022-23. By renewing the Building Utilities and Services Agreement with the School District, the City will continue to recover actual maintenance and operations costs for the next fiscal year.
 
18.   Landlord's Consent to Leasehold Deed of Trust related to the City's Retail Commercial Parcel located at  910 E. Birch Street (Lessee: Nesbitt Partners Brea Venture, Ltd.) - Authorize the City Manager to execute attached Landlord's Consent to Leasehold Deed of Trust to allow Nesbitt Partners Brea Venture, Ltd. ("Nesbitt") to sale the improvements, equipment, and other personal property located on the Retail Parcel located at 910 E.Birch Street. There is no fiscal impact to the General Fund. 
 
19.   Maintenance Agreement for Asphalt Maintenance & Repairs Throughout the City - Award the annual Asphalt Pavement Maintenance Agreement to Ben’s Asphalt, Inc. The Streets Division (Fund 110) and Water Division (Fund 420) have $100,000 budgeted in each respective operating account to cover the services to be provided by the contractor.
