Conditional Use Permit No. CUP 20-10 – A Request to Allow the On-Premise Sale of Alcoholic Beverages at an Existing Restaurant Located at 131 South Kraemer Boulevard, Suite A in The Planned Community (P-C) Zone.
RECOMMENDATION
Staff recommends the Planning Commission approve Conditional Use Permit No. CUP 20-10, subject to the conditions in the draft Resolution.
BACKGROUND/DISCUSSION
BACKGROUND
Alza Osteria is a casual sit-down restaurant that has been in business for over 30 years and is located in a shopping center at the northwest corner of East Birch Street and South Kraemer Boulevard (see Figure 1- Vicinity Map). The business includes a full-service kitchen serving lunch and dinner. The restaurant is open Sunday through Thursday from 11:00 a.m. to 9:00 p.m. and Friday and Saturday from 11:00 a.m. to 10:00 p.m. 
 
DISCUSSION
The business is situated in the P-C Planned Community Zone and is subject to the Silver-Birch Retail-Commercial Master Plan.  Alza Osteria currently possesses a Type 41 On-sale Beer and Wine license from the State Department of Alcoholic Beverage Control (ABC).  The existing restaurant and on-site sale of beer and wine is permitted by the Master Plan.  The applicant is requesting to add liquor and spirits to its menu options.  If this application is approved by the Planning Commission, the applicant would apply to the Department of ABC for a Type 47 license which permits the on-premise sale and consumption of beer, wine, liquor and spirits in conjunction with a restaurant.  The request is consistent with the Master Plan, which identifies restaurants as permitted uses.
 
There are two other restaurants in the center where Alza Osteria is located.   Shady Nook Sports Bar maintains a license to serve beer and wine as a bar or tavern (CUP 09-04). La Puerta Mexican Food does not serve alcohol.  The modification to Alza Osteria’s liquor license would not affect the overall character of the shopping center.
 
It is not uncommon for restaurants to offer a full range of alcoholic beverages. Examples in Brea include Lucille’s BBQ, The Yardhouse, and Cedar Creek Inn.  The City has not received excessive calls for police services or other complaints related to the service of beer and wine at Alza Osteria.  The applicant would be required to comply with all terms of its license from the ABC, which address issues such as prohibitions on service to minors and require the ongoing service of food at the restaurant.  Therefore, approval of this request is not expected to have negative impacts on surrounding businesses or residents. 
ENVIRONMENTAL ASSESSMENT
The proposed project is exempt from the requirement of the California Environmental Quality Act (CEQA) pursuant to Section 15301 of Title 14, Chapter 3, Article 19 of the California Code of Regulations.
