Conflict of Interest Code Amendments
RECOMMENDATION
Adopt Resolution No. 2022-063 amending the City of Brea Conflict of Interest Code to conform to organizational changes and current State law for designated City employees.
BACKGROUND/DISCUSSION
The Conflict of Interest ("COI") Code designates positions which make or participate in City government decisions which may foreseeably have a material effect on any financial interest. Brea first established its own COI Code for designated City personnel in 1977. In 1980, the City established a new COI Code which incorporated by reference, the standard model of the Fair Political Practices Commission ("FPPC").  This minimized the actions required to keep codes in conformance with the Political Reform Act making any FPPC update to the Code automatically law in the City of Brea. 

The Political Reform Act states that every agency shall amend its COI Code when necessitated by a change in circumstances, including the creation of new position, which require designation and relevant changes to the duties assigned to existing positions. The City Council last amended the Designated Employees List in 2020.  

By October 1, 2022, the City Council must determine that no amendments to the COI Code are necessary, or other that required revisions be submitted for adoption within 90 days. The City Clerk has determined that revisions to the COI Code for employees are required to reflect new, removed, and reclassified positions. 
FISCAL IMPACT/SUMMARY
There is no fiscal impact.
