Public Sidewalk Easement for 114 North Berry Street
RECOMMENDATION
Accept public sidewalk easement and authorize City Clerk to execute and record the Deed of Easement.
BACKGROUND/DISCUSSION
On August 16, 2021, City staff received a Building Permit Application for modifications to the existing surface parking lot of the property located at 114 N. Berry Street. Part of the scope of project being proposed by the property owner, IDIL 114 Berry, LP, included the reconstruction and widening of an existing driveway apron, located at the southeast corner of the property, in order to facilitate the truck turning movements necessary for the proposed future business operations.
In order to meet Brea City Code and Americans with Disabilities Act requirements, a 5-foot sidewalk landing was required at the top of the proposed driveway apron. In order to tie the existing grades of the adjacent street to the grades of the proposed on-site development, this 5-foot sidewalk landing was located within private property. A public sidewalk easement is required for public access of this sidewalk facility. See Exhibit A, attached herein, for the property location and the location of the proposed public sidewalk easement. The Deed of Easement has been prepared for the proposed sidewalk easement and has been reviewed by the Engineering Division. Refer to Exhibit B, attached herein, for the Deed of Easement.
FISCAL IMPACT/SUMMARY
There is no General Fund impact from the acceptance of this public sidewalk easement. The Deed of Easement for public sidewalk easement has been reviewed by the Engineering Division for form and the legal description of the easement area. Staff recommends City Council to accept the Deed of Easement for the dedication of public sidewalk easement and to authorize the City Clerk to execute and record the Deed of Easement.
