RECOMMENDATION |
Receive bids, award contract, and authorize the Interim Public Works Director to issue Contract Change Orders up to a "not to exceed" amount of 10% of the contract price. |
BACKGROUND/DISCUSSION |
The Glenbrook Tract Waterline Improvement and Street Rehabilitation Project 7452, was approved for construction as part of the Capital Improvement Program (CIP). Project 7452 is located in the residential streets of the Glenbrook Tract neighborhood bounded by Birch Street to the north, Orange 57 Freeway to the west, Greenbriar Lane/Hillhaven Drive to the south, and the Brea Union Plaza to the east. See the attached Vicinity Map.
The project scope includes rehabilitating the existing pavement of the residential streets, replacement of approximately 12,700 linear feet of water main, services, gate valves, fire hydrants, appurtenances, replacement of damaged and/or uplifted sections of sidewalk, curb and gutter, and reconstruct curb access ramps in compliance with Americans with Disabilities Act (ADA) requirements.
The improvements will be constructed on Fig Avenue, Eucalyptus Street, Plum Avenue, Redbay Avenue, Camphor Circle, Valverde Avenue, Aurora Avenue, Holly Street (street and fire hydrant improvements only - water mains were replaced in 1989), Chevy Chase Drive, Hillhaven Drive, Green Briar Lane, Eucalyptus Lane, Amberwick Circle, Windermere Circle, Heather Circle, Dover Avenue, Amberwick Lane, Heather Lane, and Devonshire Drive.
On October 16, 2015, the City Council approved the plans and specifications, and authorized the City Clerk to advertise and receive bids for the subject project. On January 21, 2016, staff received fifteen (15) bids. Following the bid opening, staff reviewed the apparent low bidder, MCC Pipeline Inc. ($2,437,750.30), as well as the next two (2) bidder's proposals, Gentry Brothers, Inc. ($2,613,805.00) and Dominguez General Engineering, Inc. ($2,843,145.00).
Staff discovered MCC Pipeline Inc. and Gentry Brothers Inc. did not submit and/or acknowledge the addendum issued as part of the bid proposal. Although the third lowest bidder’s proposal conformed to the bid requirements, their bid amount exceeded the construction budget. After consultation with the City Attorney, staff recommended to City Council to reject all bids and re-bid the project.
On February 16, 2016, the City Council rejected the bids and authorized staff to re-bid the project. Soon thereafter, staff re-advertised the bids and on March 22, 2016, thirteen (13) bids were received with six (6) bids deemed non-responsive at the time of the bid opening. These six (6) bidders did not attach the addendum to their bid proposals, per bid requirements, and thus their bids were not read. After additional bid evaluation, staff determined that the six (6) disqualified bids were greater than the lowest responsive bidder. Below are the results of the bids:

The lowest responsible bidder was O’Duffy Bros., Inc. of Romoland, California in the total amount of $2,397,058. The company has a valid contractor’s license and has been in the construction business for 24 years. O’Duffy Bros., Inc. has not previously worked for the City; however, they recently completed similar projects for the Cities of Corona, Victorville and Inglewood. Their projects were completed satisfactorily. If awarded, construction could begin in May 2016, and take approximately eight (8) months to complete. |
SUMMARY/FISCAL IMPACT |
Project 7452 will install new water lines and resurface the streets in the Glenbrook Track neighborhood. This project was originally bid on January 21, 2016. Because of irregularities in the bid proposals, staff recommended to City Council to reject all bids and re-bid the project, which was approved by City Council on February 16, 2016; therefore, staff re-bid the project and on March 22, 2016, staff received thirteen (13) bids with the lowest responsive bid from O’Duffy Bros., Inc. in the amount of $2,397,058. Staff is requesting that City Council award the contract to the lowest responsible bidder, O’Duffy Bros., Inc., in the amount of $2,397,058.
The total approved budget for FY 2015-16 for project 7452 is $2,900,000, with funding coming from a combination of Measure M ($663,000), Sewer ($30,000), Urban Runoff ($7,000), and Water ($2,200,000) funds. There is no General Fund impact. Below is the project expenditure summary.
